One of the most common HR compliance issues for small businesses is that the statement of main terms often does not fulfil Section 1 of the Employment Rights Act 1996. This section requires a framework for key clauses, and many businesses limit their rights by not covering ‘what if’ scenarios in their contracts. For example, issues like deduction of wages, short service dismissal, recouping training costs, and the consequences of employees not serving correct notice are often overlooked. Additionally, many businesses lack a handbook that outlines the rules, regulations, and expectations of the business. A handbook is crucial for ensuring consistency and demonstrating fair procedures.

Small businesses can stay compliant by outsourcing support, keeping updated with government changes, and relying on credible sources of information—not just Google.

Investing in your employees supports both retention and development. Having a structured development plan for your staff helps address their training needs and ensures the business is prepared for future challenges.

Can you share a brief example of an HR challenge you’ve helped a business overcome?

Certainly. We had a case where a business faced false allegations of discrimination. We structured our approach and disassociated any risk by following procedures. A thorough grievance hearing and investigation led to the concerns not being upheld. The problematic employee was toxic, causing constant issues. With a structured audit trail of challenges, our contracts supported the business in achieving a short service dismissal, allowing for a quick removal and closing any potential allegations.

Two effective ways to foster a positive and inclusive workplace culture are maintaining regular communication and celebrating success. These practices help build a cohesive and supportive work environment.

Is hybrid working here to stay, or will companies slowly phase out hybrid and remote roles/contracts as they try to get people back into the office?

Hybrid working is potentially here to stay, but it depends on business requirements. Contracts should clearly outline the dynamics of hybrid work, such as the need to come into the office one day a week. We strongly recommend having a hybrid policy that covers productivity, breaks, and consequences of breaking rules.

What are the biggest HR challenges with remote and hybrid working?

The main HR challenges with remote and hybrid working include managing productivity, whether employees are over-productive or under-productive, mitigating the risk of sensitive data leaks, maintaining team morale, and ensuring effective communication.
